In the event of a conflict between these Terms and the Rewards Terms, the Rewards Terms shall control with respect to the applicable program.

User Opt In

By opting in to the Program through online or application-based enrollment, you agree to receive autodialed or prerecorded marketing mobile messages at the phone number associated with your opt-in. You understand that consent is not required to make any purchase from Us. Message and data rates may apply.

User Opt Out

To opt out of the Program, reply STOP, END, CANCEL, UNSUBSCRIBE, or QUIT to any mobile message from Us. You may receive a confirmation message. These are the only supported methods of opting out.

Duty to Notify

If you stop using the mobile telephone number used to subscribe to the Program (including canceling service or transferring the number), you agree to complete the opt-out process before ending your use of that number. You agree to indemnify and hold BlakJaks harmless from any claims resulting from failure to provide such notice, including claims under the Telephone Consumer Protection Act, 47 U.S.C. § 227, or similar laws.

7. Limitation of Liability

To the fullest extent permitted by applicable law, BlakJaks LLC shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from or related to your use of the Site, the Services, or any BlakJaks products or programs, including but not limited to loss of profits, data, or goodwill, even if BlakJaks has been advised of the possibility of such damages. In no event shall BlakJaks’ total liability exceed the amount you have paid to BlakJaks in the twelve (12) months preceding the claim.

You agree to indemnify, defend, and hold harmless BlakJaks LLC, its officers, directors, employees, agents, and affiliates from and against all losses, expenses, damages, costs, and claims (including reasonable attorneys’ fees) arising from your violation of these Terms, your use of the Site or Services, any content you submit or transmit through the Site, or any activity related to your account.

9. Product Disclaimer

BlakJaks products contain nicotine. Nicotine is an addictive chemical. BlakJaks products are intended for adults 21 years of age and older who currently use nicotine. BlakJaks products are not intended to diagnose, treat, cure, or prevent any disease and are not a smoking cessation product. Persons who suffer from heart disease, high blood pressure, diabetes, or who are pregnant, nursing, or considering becoming pregnant should consult a physician before using any nicotine product. 11. Dispute Resolution & Arbitration

In the event of any dispute, claim, or controversy arising out of or relating to these Terms, your use of the Site or Services, or any BlakJaks program, such dispute shall be resolved by binding individual arbitration administered by the American Arbitration Association (“AAA”) in accordance with its Commercial Arbitration Rules. Arbitration shall take place in the State of Delaware before one arbitrator.

You agree to arbitrate solely on an individual basis. This agreement does not permit class arbitration or any claims brought as a plaintiff or class member in any class or representative proceeding. The arbitrator’s decision shall be final and binding. Each party shall bear its own share of arbitration fees, though the arbitrator may award fees to the prevailing party. The arbitrator shall have no authority to award punitive damages, and each party waives any right to seek punitive damages.

If for any reason a dispute proceeds in court rather than arbitration, both parties waive any right to a jury trial. This arbitration provision survives any cancellation or termination of your agreement to these Terms.

Shipping Overview

All BlakJaks orders ship via UPS. Orders are shipped direct to the address provided at checkout. We currently ship within the United States only, subject to the restrictions listed below.

Processing & Delivery

Orders are typically processed within 1–2 business days. Delivery timelines vary based on your location and are estimates only. Tracking information will be provided via email once your order has shipped.

Shipping Cost

BlakJaks subsidizes a portion of shipping costs on standard consumer orders. Applicable shipping fees will be displayed at checkout prior to payment.

For wholesale orders, freight costs are the responsibility of the wholesale customer.

Shipping Restrictions

Due to state and local regulations on nicotine and flavored tobacco products, BlakJaks is unable to ship to certain jurisdictions. Because all BlakJaks products are flavored nicotine pouches, the following restrictions apply to our entire product line.

Return Policy

All Sales Are Final

Due to the nature of our products, all sales are final. We are unable to offer refunds or accept returns. Once an order is placed, it cannot be modified, so we encourage customers to carefully review their selections before completing checkout.

Order Cancellation

You may cancel your order within 1 hour of placement. After that period, we cannot guarantee cancellation as your order may have already been processed or shipped. If you need to change items in your order, you may cancel within 1 hour and place a new order.

Defects & Shipping Errors

We stand behind the quality of our products. If you experience an issue with your order due to a product defect or shipping error, we are here to make it right. Please contact our customer support team within 14 days of receiving your order and include your order number along with photos of the issue so we can assist you as efficiently as possible.

While we cannot process returns or refunds for reasons of personal preference, we will always work to resolve any concerns related to defects or shipping errors.

Damages

Please inspect your order upon delivery. If any items are defective or damaged, contact us immediately so we can evaluate the issue and make it right.

Refunds for Defects or Damage

If a refund is approved for a defective or damaged product, you will be automatically refunded to your original payment method within 10 business days. Please allow additional time for your bank or credit card company to process and post the refund.
